Participant User Agreement for ILIAS
1 Scope of these Terms of Use (Terms and Conditions)
This User Agreement governs the use of the ILIAS online platform (hereinafter referred to as ‘Platform’) by Coastal Minds GmbH (hereinafter referred to as ‘Provider’ or “we”) and the user (hereinafter referred to as ‘Participant’).
This agreement applies exclusively to the specific course offered by Coastal Minds GmbH on the platform.
By logging into the platform for the first time, the participant accepts these terms of use.
2 Registration, sign-up and user account
Use of the platform is linked to participation in the specific course offered by Coastal Minds GmbH.
A user account is created for use, for which a username and an initial password are assigned. The password must be changed upon first login.
The access data is provided by the Provider. The Participant is obliged to keep their access data safe and not to pass it on to third parties. Any misuse must be reported immediately.
Access to the platform will be activated no later than 10 days before the start of the course. After completion of the course, access will remain available for three months in order to continue to access materials. After that, the account will be deactivated.
3 Use of materials
The access and usage rights are non-transferable and apply only to the participant.
Materials may not be reproduced, passed on, sold or published.
4 Obligations of participants
• Participants are responsible for the technical requirements.
• Changes to the platform may require adjustments on the part of the user.
• The platform may only be used within the scope of the course. Any other use is prohibited.
• Use of the platform for illegal or inappropriate content is prohibited.
• The participant undertakes not to take any measures that could impair the functionality of the platform.
5 Property rights
• The participant only receives a personal, non-transferable right of use for the course content.
• Content may not be reproduced, distributed or published without consent.
• Trademarks and logos of Coastal Minds GmbH may not be used without permission.
• Contributions made by the participant may be used within the course, but may not be published or made available to third parties.
6 Suspension/termination of right of use
In the event of violations of these terms and conditions, access to the platform may be blocked or revoked.
Access remains available for three months after the end of the course, after which the account will be deactivated.
7 Liability
• Learning success through use of the platform is not guaranteed.
• Use is at your own risk. The provider is only liable for damage caused by gross negligence or intent.

9 Place of jurisdiction and applicable law
The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from or in connection with this contract is Rostock (the registered office of Coastal Minds GmbH).
10 Changes to the user agreement
Coastal Minds GmbH reserves the right to change this user Agreement if necessary. Users will be informed of any changes in good time. By continuing to use the platform after the changes have come into effect, you declare your agreement with the adjustments.
Privacy policy of the ILIAS online learning platform
ILIAS is free software for operating a learning platform that can be used to create and make available internet-based teaching and learning materials (for e-learning) as well as to facilitate communication and cooperation between teachers and learners, examinations and evaluation, and didactic structures for complete courses.
When you use the ILIAS learning platform, your personal data is processed.
‘Personal data’ is any information relating to an identified or identifiable natural person, e.g. name, address, telephone number, IP address. 2. Server log files
When you visit the online learning platform, data is automatically collected by our server. This information includes, among other things, the operating system used operating system used, the time of the server request, the referrer URL, the host name of the accessing device, the IP address, the browser type and browser version, and is stored in so-called server log files (log data).
Identification of individuals cannot be made using the data collected. All data is regularly deleted and is not linked to other data sources.
Processing is carried out on the basis of Art. 6 (1) lit. f GDPR due to our overriding legitimate interest in ensuring trouble-free operation and improvement (e.g. error correction, maintenance, misuse etc.). In the event of actual misuse, this data is stored for as long as it is needed to preserve evidence.
3. Cookies
The ILIAS learning platform uses cookies. Cookies are small text files that are stored in the internet browser or by the internet browser on a user's computer system. When a user accesses a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is accessed again.
Cookies help ILIAS to distinguish your browser from other browsers. They store your settings and at the same time ensure the security of users and operators. With the help of cookies, ILIAS can check whether a page is really being accessed by the person who is authorised to do so.
Cookies are stored on your computer, and you have full control over them. In your browser settings, you can block cookies, decide whether to accept them and delete stored cookies. ILIAS uses both temporary cookies, which are deleted after closing the browser, and permanent cookies. In your browser settings, you can see which cookies have been stored by ILIAS and delete them.
However, please note that for technical reasons, it is not possible to use ILIAS without cookies. The processing of data is based on Art. 6 para. 1 lit. f) GDPR, as we have a legitimate interest in providing the learning platform.
4. Internal learning tracking
Internal learning tracking takes place via ILIAS.
Internal learning tracking stores learning status information for certain objects in ILIAS, such as user name, surname, first name and the statuses ‘Not yet started’, ‘In progress’, ‘Completed’ and “Failed”. From the ‘In progress’ status onwards ‘In progress’, the timestamps for the first and last access, the number of accesses and the time are also recorded.
Internal learning tracking is disabled by default and must be enabled by the Administrator or course administrator for a course.
Administrators and course administrators can access the data. Administrators are selected employees of Coastal Minds GmbH and the contracted service provider. We have concluded a contract processing agreement with our service provider.
Data processing is carried out on the legal basis of Art. 6 (1) lit. b) GDPR. We process your data to fulfil the contractually owed services of the online learning programme.
5. LRS
Learning tracking also takes place in an external Learning Record Store (LRS).
The provision of learning materials with external learning tracking mainly takes place in the courses of the SiFa learning environment.
The system makes it possible to record and track the performance of learners and therefore ensures a better overview of all types of learning activities. We store information about the time, duration and result of a learner's interaction with an object. When data is transferred from ILIAS to the Learning Record Store, the data is pseudonymised. The Learning Record Store is hosted on the servers
of our service provider.
Administrators and course administrators can access the data. Administrators are selected employees of Coastal Minds GmbH and the contracted service provider. We have concluded a contract processing agreement with our service provider.
Data processing is carried out on the legal basis of Art. 6 (1) lit. b) GDPR. We process your data to fulfil the contractually owed services of the online learning programme.
6. Registration
To use ILIAS, you must register on the learning platform.
We collect the following registration data:
• Username
• Password
• First and last name
• Title
• Email address
In addition, you can voluntarily provide us with further personal data, such as your interests and contact information.
You can enter, change or remove this information at any time on the ‘Personal data and profile’ page in the ‘Personal data’ tab.
In the ‘Profile’ tab, you can specify whether and with which details your personal profile is displayed to other users after they have registered with ILIAS. If your personal profile is not activated, ILIAS will only display your user name for user-generated entries (e.g. comments, forum posts, blog posts, entries in wiki pages). If, on the other hand, your personal profile is activated, your first and surname will be displayed and shown as a link to the information you have shared.
The legal basis for data processing is Art. 6 (1) (b) GDPR. We use your data exclusively to create personal access to the learning platform.
7. Use
The learning platform can be used for learning, teaching and communication purposes. Relevant user groups are:
• Teachers
• Other course participants
We process different personal data depending on the user group. For teachers, we process the following personal data:
• Registration data (e.g. user name, first and last name)
• Authorisations (e.g. role on the platform)
• Teaching history (e.g. courses)
• Content (e.g. materials)
For other course participants, we process the following personal data:
• Registration data (e.g. user name, first and last name)
• Authorisations (e.g. role on the platform)
• Learning history (e.g. course of study or education, participant lists)
• Learning progress (e.g. learning success, exercises, tests, certificates)
• Content (e.g. entries)
In ILIAS, there are various objects that give users the opportunity to enter their own content. These include groups, wikis, forums, blogs, chats, data collections, tests, polls and exercises.
Administrators have global access to your personal data. These are selected employees of Coastal Minds GmbH and its contracted service providers. If our service providers are given access to your
personal data, this is done on the basis of a contract processing agreement with the service provider.
Teachers and course administrators have limited access to your personal data. These groups of people have access to information about the participants in their course and can view data such as user name, first name and surname, and, where applicable, data from ILIAS internal learning tracking. Other users can usually see your user name. You can decide for yourself whether to share further profile information and personal objects. For example, you can allow contact requests.

We do not transfer your data to third parties unless we are legally obliged to do so.
The legal basis for data processing is Art. 6 (1) (b) GDPR. We process your personal data for the purpose of fulfilling the contract concluded with you as a teacher or learner.
8 Storage period
Your personal data will be stored for as long as your user account exists.
Upon successful deletion of a user account, all personal data will be removed. A deleted user account cannot be reactivated. The user account can be deleted at your personal request or automatically due to inactivity. Your user account will be deleted after 1,000 days of inactivity.
With a few exceptions, all content generated by users can be deleted by the users themselves. Exceptions to this include, for example, chat posts, files submitted via the ‘Exercise’ object and emails sent by users to the inbox of another user. Except for the email function , there is no recycle bin for user-generated data. If you delete the personal objects you have generated, these objects will be completely deleted after a security prompt. Emails can be moved to the recycle bin and completely deleted from the recycle bin using the ‘Empty recycle bin’ function. Some user-generated content, such as posts in discussion forums, comments on existing content or entries in wiki pages, will remain even after your user account has been deleted. In all places where a user name or first and last name was previously displayed, the note ‘User deleted’ or ‘Anonymous’ will appear after the user account has been deleted.
9 Your rights as a data subject
You are affected by data processing by Coastal Minds GmbH.
As a data subject, you have the following rights:
• You have the right to information about the data we have stored about you.
• If we have processed incorrect data about you, you can request correction of this data.
• If the relevant conditions are met, you can request that we delete your data or restrict the processing of this data.
• You also have the right to receive the data you have provided to us in a structured, commonly used and machine-readable format.
• If we process your data on the basis of Art. 6 (1) e) or f) GDPR, for example because we pursue legitimate interests, you can object to this processing in accordance with Art. 21 GDPR.
